Welcome to SteadyBrand! These Terms and Conditions ("Terms") govern your use of the SteadyBrand website, application, and services (collectively, the "Service"), provided by [Your Company Name] ("we," "us," or "our").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

SteadyBrand is a Software-as-a-Service (SaaS) platform that utilizes artificial intelligence to help users generate written and visual content ("AI Content") that aligns with a user-defined brand voice ("Brand Profile").

2. User Accounts

  • Registration: To access most features, you must register for an account. You agree to provide accurate and complete information and to keep this information updated.
  • Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
  • Age Requirement: You must be at least 13 years old to use the Service.

3. Subscriptions, Billing, and Free Trial

The Service is offered under several plans:

  • Free Plan: This plan is free of charge and allows for a limited number of AI text generations (e.g., 10 per month) and a limited number of Brand Profiles (e.g., 1). We reserve the right to change the limits of the Free Plan at any time.
  • Pro Plan: This is a paid subscription that offers expanded limits (e.g., unlimited text generations, 5 Brand Profiles) and access to premium features such as Generation History, Content Repurposing, and the AI Editor.
  • Business Plan: This is a paid subscription designed for teams, offering all Pro features plus additional benefits like more Brand Profiles and user seats.
  • Free Trial: We may offer a free trial for the Pro Plan (e.g., 14 days). You will be required to enter your payment information to start the trial. You will be automatically charged the subscription fee on the first day following the end of the trial period, unless you cancel before the trial ends.
  • Billing: All payments are processed by our third-party payment processor, Stripe. By subscribing to a paid plan, you agree to their terms and conditions. Subscriptions are billed in advance on a recurring monthly or annual basis.
  • Cancellations: You may cancel your subscription at any time through our Billing page, which will redirect you to the Stripe Customer Portal. Your cancellation will take effect at the end of the current billing cycle, and you will not be charged again. We do not offer refunds for partial subscription periods.

4. Content Ownership and Responsibility

  • Your Content (Brand Profiles): You retain full ownership of the content you provide to create your Brand Profiles (your target audience, tone of voice, examples, etc.). You grant us a worldwide, non-exclusive, royalty-free license to use, process, and store this content solely for the purpose of providing the Service to you.
  • AI-Generated Content: Subject to your compliance with these Terms, you own the AI Content generated for you by the Service. You are free to use it for any personal or commercial purpose. However, you acknowledge that due to the nature of machine learning, the AI Content may not be unique across all users, and the Service may generate the same or similar output for other users. We make no warranty as to the uniqueness or copyright eligibility of the AI Content.
  • Responsibility: You are solely responsible for the AI Content you generate and its subsequent use. You must ensure that your use of the Service and the AI Content does not violate any applicable laws or infringe on the rights of any third party.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, defamatory, obscene, or hateful.
  • Generate content that infringes on any intellectual property rights.
  • Generate spam or content for deceptive practices.
  • Reverse-engineer or attempt to extract the source code or underlying models of the Service.
  • Abuse the Service by creating multiple free accounts or attempting to bypass usage limits.

6. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied. In no event shall SteadyBrand be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
